We are having another Bus Tour this year!!

 The Bus Tour seems to have already become a yearly event. In order to deepen friendly exchanges between our members and participants, we go on a tour with about 40-50 persons of different nationalities. In the past we have gone to Numazu, White Beaches of Izu, Yatsugatake, and Kozushima(a boat trip).
 This year, we are planning to go to Mount Fuji and Lake Kawaguchi on September 14th and 15th. The cost for the trip shall be 16,500 yen. We shall send information later on the schedule for the tour and the way to sign up.
We plan to do a lot on this trip including visiting a winery, walking part of Mount Fuji, and visiting the lake. The lunch for the first day will be a bento made by APFS that we can all eat together.
 Hassan in the office says that Japanese volunteers and women of all nationalities are encouraged to participate freely.
Hassan joined the bus tour for the first time last year. He says, "It was a really fun experience. Since I'm planning this year's trip, I am creating fun events like a Barbeque, some fireworks, and a Bingo competition on the bus. I want everyone to enjoy themselves!"

今年もバスツアーが行なわれます!!

 APFSではすでに毎年恒例となっているバスツアー。会員や参加者の親交を深めることを目的に、40〜50名程度の規模で、さまざまな国籍の方々の参加によりツアーを行なってきました。過去の行き先は沼津、伊豆の白浜海岸、八ヶ岳、長瀞、神津島(船旅)などです。
 そのバスツアーを、今年も例年どおり行ないます。今年は来る9月14、15日に、富士山、川口湖周辺のツアーを企画しています。おもな内容は次のとおりです。

・日時…9月14(土)、15(日) ・行き先…富士山、河口湖など 
・参加費…16,500円

 ツアーのスケジュールや申込方法については、後日、別のお便りでお知らせします。
 今年も、富士山中腹の散策、ワイナリー見学、河口湖散策など盛りだくさんの内容です。初日の昼食はAPFSが弁当を用意し、みんなで食べることになります。
 事務局長のハッサンさんによると、ここ数年はボランティアスタッフとして関わっている日本人の参加者が減っているので、今年はより多くの人に参加していただけるようにしたい、また、女性も気軽に参加できるようなものにしたい、とのこと。そのハッサンさん自身は、昨年(沼津)が始めてのバスツアー参加でした。
 「去年参加して、とても楽しかったです。今年は今、企画担当者どうして話し合って、宿泊先でのバーベキュー大会や花火大会、バスの中でのビンゴ大会など、楽しいイベントも検討中です。とにかく楽しめるツアーにしたいですね」(ハッサンさん)
 みなさん、ぜひ、2002年度バスツアーへの参加の呼びかけのお手紙にご注目ください。


Our Statement to the Justice Ministry
including creating a standard for Special Residence Permission

On June 27th, APFS submitted a request to the Ministry of Justice. In it, we asked that the Japanese government reconsider its treatment of foreign citizens in its policies. This included, "Please clarify standards for Special Residence Permission," "Since children of overstay residents are guilty of no crime, could you grant them stay?" and "Please clarify standards for temporary release from detention."
Once we received a reply, APFS was able to begin presenting questions to and negotiations with the Ministry. Five persons on the APFS side (Congress member, Ueda, Representative Yoshinari, Administrator Tsugawa, etc.) met with five persons (Immigration Investigation Department Head Kawakami, Head guard Nishiyama, etc.) assigned to handle our request.
Currently, 2,000,000 foreigners live in Japan under different conditions. Exchange students, industrial laborers and many others, all are extremely valuable in supporting Japanese society. From this, it is clear that Japan must face its multi-cultural and multi-ethnic society.
However, the Ministry of Justice seems to be ignoring both the trends of the times and human rights. They responded that there are no standards for Special Residence Permission or the process in which it is decided. They also insisted that there is no statistical information on overstay foreigners and there are no standards for deciding temporary release. Basically, they are saying no standards exist anywhere.
Both the Ministry and Immigration say that there are no standards but in each case they make decisions according to a review of humanitarian and welfare issues. However, since people usually rationally set standards for their decisions, we believe that when they think of "humanitarian and welfare issues" they must have a standard to define what they are thinking.
Up until now, we have seen a pattern in how Special Permission has been granted. Especially since 1999, in our Movement for Special Permission, many applicants were granted residence. It seems that when their reason for applying is based on the stability of their lifestyle, more persons are granted permission.
We want to continue these structural negotiations between both sides so that we may create a Japanese society where all foreigners, with visas or not, may pursue fulfilling lives.
Also, while we were in negotiations, we could hear the wonderful support of all you who were gathered out front! Let's continue to fight to create a society that respects ALL human rights!!

対法務省申し入れ行動を実施
―在留特別許可の基準の明確化などを求めて―

 6月27日、APFSは、法務省に対して申し入れを行いました。内容は、日本政府の外国人政策に関し、根本から見直すよう求めるものです。その中には、「在留特別許可の基準を明らかにしてください」、「非正規滞在外国人の子ども達には何の罪もないので、在留の権利を認めたらどうですか」、「入管収容における仮放免の基準を明らかにしてください」等の申し入れ項目もありました。
 交渉はまず、法務省側から申入書に対する回答がなされ、それに続いてAPFS側から質問するという形式をとって行われました。当日は、植田むねのり議員、APFSからは吉成勝男代表、津川勤運営委員ら5名が、法務省側からも川上章入国審査課長、西山秀明警備課長補佐ら5名が出席して申し入れが行われました。
 現在、日本には200万人近くの外国人が様々な在留形態で生活をしています。留学生や、産業の最底辺で就労する人たちなど、日本の社会にとってかけがえのない人たちばかりです。このようなことから、日本が多文化・多民族社会へと向かっていることは明らかです。
 しかしながら、入管・法務省側の回答は、時代の趨勢や人権を無視したものでした。在留特別許可(以下、在特)の具体的基準は存在しない、よって、在特審査過程にも具体的な基準は存在しない、非正規滞在外国人家族に関する統計的資料は存在しない、仮放免に関する具体的基準も存在しない、「とにかく基準はない」という一点張りでした。
 法務省・入管側としては、各規準は存在しないけれども、いずれも人道的・福祉的見地から検討を行っていくとの回答でした。しかし、人間が理性的に何かを決定するには何かしらの基準が存在しているので、「人道的・福祉的見地から検討」というならば、「人道的・福祉的見地から検討」する基準が存在するはずだと私達は考えています。
 今までAPFSや外国人支援団体が行ってきた運動の中で、在特取得の基準はある程度浮彫りになって来たと私たちは考えています。特に1999年以降の「在留特別許可一斉行動」では、多くの人に在特が認められました。非正規滞在外国人の家族において、生活基盤が形成されたことを理由として在留特別許可がこれほど多数認められたこと、これは画期的なことと考えています。
 これからも、双方で建設的な論議を交わして、非正規滞在外国人が、一刻も早く生き生きとした生活を日本で送れるように働きかけていきたいと考えています。
 申し入れの最中も、法務省前で旗を掲げ応援している皆さんの声が届いて来ました。今後とも真に人権が尊重される社会をともに築き上げていきましょう。


The Free Medical Exam for Foreign Citizens

 On Sunday, July 14th, from 11 in the afternoon, we held our regular "Free Medical Exam for Foreign Citizens" in Sambun Hall. As usual, it was co-sponsored by APFS and SHARE, and 159 persons came for a medical check. APFS worked doing reception, guidance, and translation, and all our volunteers worked hard and worked together to the end.
Foreign citizens living in Japan cannot get medical insurance without a proper visa. As a result, if they choose to go to get medical help, the costs become extremely high, so many people avoid going to doctors at all. This results in many serious illnesses from being found early. Therefore, it is presently necessary that foreigners have opportunities, such as free check-ups, to confirm their health.
The exams available at the check-up included: chest X-rays, blood tests, urine analysis, physical exam, and dental and medical consultations. Exam results are sent to participants through the mail later.
Exams and consultations were held on the second floor in a large hall, but since reception and the X-rays were outside, we were worried about the people who had made a line on such a hot day. Everyone seemed to be having a hard time in the heat. We should have arranged for the reception to be held indoors. Also, since the X-ray machine overheated, the end of the exams were delayed an hour. We will remember this as we plan our next free check-up.
But, the fact that we were able to see so many people without great trouble makes us feel that the event was a great success. People said, "Since we don't have many chances for a check, this really helps" and "Please hold another next year." We are now even more convinced of the necessity for this work.
Now, for a summary of the nationalities of people who participated.
Burma-83 persons, Nepal-39 persons, Bangladesh-21 persons, the Philippines-6 persons, India, Iran, Pakistan, Malaysia, Vietnam, and others-1 to 2 persons from each.

ー「外国籍住民のための無料健康診断」が行なわれましたー

 7月14日(日)午前11時より、産文ホールにおいて、恒例の「外国籍住民のための無料健康診断」が行なわれました。例年どおりAPFSとSHAREが協力して実施され、総数159名もの外国籍住民に健康診断を受けてもらうことができました。APFSは受け付け、誘導、通訳などを受け持ち、ボランティア全員が一丸となって最後までがんばりました。
 在留資格を持たない非正規滞在の人々には、保険制度が適用されません。したがって医療機関にかかった場合、とても高額の治療費を負担しなければならないのです。そのため病院に行くのをためらい、早期治療の機会を逃してしまう人たちは後をたちません。重大な疾病を早目に発見するため、今回のような無料の健康診断は、外国籍住民、とくに非正規滞在者にとってはとても重要で有意義なものといえるでしょう。 
 当日行なわれた内容は、胸部X線撮影、血圧測定、尿検査、身体測定、歯科相談、医療相談で、検査結果は後日、本人に郵送で通知されます。
 各種検査、相談は基本的に2階の大ホールで行なわれましたが、受け付けとレントゲン撮影は建物前の私道で行なわれたため、炎天下の中、受診者が長い行列を作っていたのは気になりました。皆、一様に暑さに苦しめられていた様子です。あらゆる天候にそなえ受け付けは建物内に設置すべきだったかと思います。また、レントゲン車がオーバーヒートしたこともあり、終了時間が1時間オーバーしてしまいました。これも次回への反省点といえます。
 とはいえ、1日でこれだけ多数の受診者を受け入れ、大過なく終えることができたのは大成功であったといえるでしょう。受診者たちからも「こういう機会はあまりないので助かる」「来年もぜひやってほしい」といった声が次々に寄せられました。やはりこうした催しは絶対に必要であると痛感した次第です。
  なお、受診者の国籍の内訳は以下のとおりでした。
 ビルマ83名、ネパール39名、バングラデシュ21名、フィリピン6名、その他インド、イラン、パキスタン、マレーシア、ベトナムがそれぞれ1〜2名。

The Things Your Bosses Say
During Labor Consultations

When we work with labor consultations, it all begins with a phone call to the company. At that time, the response from the boss usually follows a certain pattern. Here, we would like to summarize that information for you. We can better understand what conditions many laborers are faced with. We will give some cases below.
1. Cases of unpaid wages
a. When basic wages are unpaid-"I have no money right now, so I can't pay. Once the money comes in I promise to pay, so just wait." "All my funds are secured so even if you take me to court, nothing can be done."
b. When additional wages for overtime or night labor are unpaid-"Overtime pay is included in the basic hourly wages," "The employees know that there is no overtime pay when they enter the company," "I don't understand why they ask for this money after they quit, they should have asked before," "Small companies like mine cannot afford the cost of obeying the law. We're not rich like big companies."
 In both cases of a and b, many bosses respond with, "But I'm the victim. I should be asking for compensation!" This is because sometimes the employee had been living in a company apartment and left suddenly without checking that all expenses (electricity, gas, water, damages) were paid.
2. Cases of fired employees
 "I fired them because the police came to me saying they were overstaying their visa. You should talk to the police," "Since we have less work because of the bad economy, I warned the employees to begin to search for new work," "They were only daily labor," "I did the best I could for my employee."
3. Cases of injuries
 "Foreign employees aren't covered in injury insurance (but Japanese employers are)," "We don't have the money to pay to enter injury insurance," "With an injury like that, Japanese employees keep working," "Here we have always had people lose a finger or two. Japanese people never complain so much," "We don't want to report the injury," "If they work every day, we pay wages. They can just continue to work by cleaning or something," "I have heard nothing about an injury, they should have told me before that something was wrong."

 In all cases of 1, 2 and 3, bosses often tell us that "If you come here to talk with us, we'll call the police," "Labor laws don't apply to foreigners," "APFS should not be involved. If employees have a problem, they should come and talk to us themselves. You must be telling them to cause problems," "I sympathized with and took care of that employees, but now with all this talk, I'll never hire another foreigner again!" "If you're really Japanese why do you just try to help these foreigners, you should be helping us!"
The above is your bosses' excuses "on parade." This long, troubled(?) road is what we face as we begin to solve consultation cases. (Tsugawa)

労働相談の現場から ―社長さんたちの「言い分」―

  相談受付後の解決に向けた活動は、まず、会社に電話を入れることから始まります。
 その際に社長がどのような「主張」をしてくるかは、だいたいパターン化してるので、今回はそれを具体的にまとめてみましょう。移住労働者を取り巻く厳しい労働事情の理解の一助になれれば、との思いから。以下、ケース別に紹介しましょう。

1. 賃金不払の場合
 a.給料本体の不払の場合
 「金が全くないので支払えない、入金したら支払うから待ってくれ」「資産は全部担保に入ってる。裁判(差押え)をやっても無駄だ」
 b.残業や深夜労働の割増代が不払の場合
 「時給○○円には割増代も含めている」「割増代をつけないことを本人が了承して入社した」「なんでやめてから言ってくるのか。会社にいる時に言えばいいじゃないか」「私らのような小さな会社は、法律を守っていたらやっていけない。大企業とは違う」

  a・bとも共通して、次のような代金の要求や、「相殺だ。むしろ損害賠償を求めたいくらいだ」との発言も多い。会社が負担していたアパート(工場の片隅に置いてある小さなプレハブであることが多い)代や電気・ガス・水道代、就労中に壊した機械の修理代、本人が黙って突然いなくなり仕事に支障をきたしたという被害代、などです。

2. 解雇の場合
 「警察からオーバーステイを就労させるなと注意を受けたので解雇した。警察と話をしてくれ」「不況で仕事がなくなってきたので、以前から本人には何度も他の仕事を探しておいてくれと言ってある」「日雇いだから」「これまで本人にはちゃんと誠意を尽くしたはず」

3. 労災の場合
 「外国人だから労災保険に入っていない。日本人は入っているが」「さかのぼって労災保険に入る金がない」「この程度のケガなら、日本人ならちゃんと働いている」「私らの職場では昔からみんな指の1本や2本潰している。日本人は労災だとか、がたがた言わない」「労基署に事故を知られたくない」「毎日タイムカードを押せば給料分は払う。会社の掃除くらいやったらどうだ」「本人から事故の話を聞いていない。以前から○○が痛いと言っていたはず」

  1・2・3の場合に共通する発言としては、「会社に話をしに来るなら、警察に通報する」「オーバーステイには法律(労基法や労災保険法など)は適用されない」「お前ら(APFS)は関係ない、文句があるなら本人が会社に来い。お前らが本人に後ろで知恵をつけさせたんだろう」「本人に同情して世話してやったのに、今さらこんなことを言ってくるとは裏切られた。もうガイジンは雇わない。こりごりだ」「あんたも日本人ならガイジンばかり助けないで、私達も助けてくれ」など。

  以上、社長さんの「言い分」オンパレードでした。これを入口に、解決に向けた長く苦しい(?)道のりが始まるのです。それについては、また、別の機会に。(津川 勤)
