「現に戦闘行為が行われておらず、かつ、そこで実施される活動の期間を通じ
て戦闘行為が行われることがないと認められる」地域を「後方地域」として、安
全だからここで米軍を支援せよと定めているのが周辺事態法ですが、「後方」も
安全ではないと、ユーゴ空爆を行う米軍は支援要員に対して危険手当と税金免除
の措置を出しました。日本の政治家の言う「後方」の幻想に気付くためにも、こ
のユーゴ事態を冷静に分析する必要があるでしょう。
「危険地域」として指定されているのは以下のAir Force News記事に書いてあ
るように、イタリア、ギリシャ、ハンガリーの軍事基地又はその近傍。NATO司令
官も、同地域で従軍したり戦闘支援行為を行っている人間は免税の対象となると
いう通告を行いました。
周辺事態法は罰則がないから「不備」だ。有事法制まで進まねばという政治家
先生の声が大きくなっていますが、実際にはこういう措置を法律に盛り込まない
と戦時の協力は得られないはずなのですが（日本人は人がいい？）。「どうせ北
朝鮮は日本本土を攻撃する能力がない」と高を括っているのは解りますが、下の
地域だって、ユーゴ軍は攻撃する能力が無いというのが軍事的な常識のはずです。
勝手に「ここは大丈夫」と決めてかかる主観主義の上に現在の事態法の「安全」
の幻想が築かれています。
米軍基地周辺の自治体は（協力する意思があるなら）、「周辺事態」に際して
特別交付金をもらうか、その地域に住む人たちは税金免除措置を取ってもらうと
か、それを法制化する運動をやらないといけない。逆にもし協力するつもりがな
いなら、事前に非協力を宣言しておかないと、危険と損害を被るだけです。
一昨日でしたか、民主党が有事の際に「合理的に国民の権利を制約する」有事
法制の骨格案を出したり、国会では「有事提案」がブームで、一気に国民を戦争
に協力させる体制作りが図られています。これを「欧米並み」の措置というなら、
同時に戦争に協力したくない人たちの権利を保護するための措置も法制化しない
とおかしい。
民間会社や自治体職員について、事態法で定める「協力」を拒否する人には
「代替労働」を与えるという「良心的軍事協力拒否」の規定です。本来憲法９条
の規定があるのにこんなことを定めるのはおかしいのですが、「事態法」や「有
事法制」だけが突っ走ってしまうと、国民は完全な無権利状態に置かれてしまい
ます。「事態法」や関連法規を廃止するか、戦時の「良心保護」規定を設けるか
どちらかだと思います。

991088. Airmen receive imminent danger pay
WASHINGTON (AFPN) -- Effective May 31, airmen supporting Operation Allied
Force in Italy, Greece and Hungary may receive $150 per month for imminent
danger pay. They may also claim a tax exclusion for pay received
within the
danger zone.
The assistant secretary of defense for force management policy approved
the
imminent danger pay May 31, thus including anyone who served in the
designated areas for any length of time starting that month.
These are the designated imminent danger pay areas:
-- Italy: Land areas of Aviano Air Base; Cervia AB; Gioia del
Colle AB;
Trapani AB, Vicenza (areas bounded within military installations);
San Vito
Air Station; Brindisi (areas bounded within military installations);
Naval
Support Activity Naples; Naval Air Station Sigonella; and NSA Gaeta.
Greece: NSA Souda Bay; Thessaloniki, land area within a 25-kilometer
radius
of 40 degrees, 27 minutes north and 22 degrees, 59 minutes east; waters
of
Themaikos Kolpos north of 40 degrees, 15 minutes north.
Hungary: Taszar, land area within 50-kilometer radius of 46 degrees,
23
minutes north and 17 degrees, 55 minutes east
Also on May 31, the supreme allied commander Europe approved a combat
zone
tax exclusion on all enlisted income for those serving in the above
designated areas and in direct support of the contingency operations.
Officers may exclude a maximum of $4,653 per month, which is equal
to the
highest enlisted base pay plus the $150 imminent danger pay.
As is the case with imminent danger pay, the tax exclusion also includes
anyone who served in the designated areas any time during May or any
portion
of a month thereafter until the reason for the pay is no longer justified.
