ペンシルヴァニア州政府矯正局は、10月11日に公告(Commonwealth of Pennsylvania Department of Corrections BULLETIN)を出し、囚人とマス・メディアの接触を厳しく規制する方針を打ち出しました。この方針は、11月11日から施行されます。
同様の規則は、すでに昨年、カリフォルニア州でも施行されたようです。
囚人の自由の制限、メディアにたいする規制の強化、という逆行現象がアメリカでも顕著になっているようです。また、それが官僚の一片の通達で決められてしまうのも、どこかの国と大差ないようです。囚人の問題であるとともに、また一面、メディアの問題でもあると思えます。こうした規制に唯々諾々とメディア側が従うとしたら、日本やアメリカでも露骨に進行しつつある検閲や「自主規制」の動きにも、歯止めはかからないでしょう。
以下は、ムミア・アブ・ジャマル氏の支援団体経由で送られてきたこの件についてのレポートです。（日本語の概要が末尾にあります）
The Pennsylvania Department of Corrections (PA-DOC) issued a new rule that bans cameras and tape recorders from media interviews with prisoners. The policy also forces prisoners to place members of the media on their visiting list if they want a face-to-face interview (with all the bureaucratic red tape and delay that changing names on a visiting list entails). To have a telephone interview , the prisoners must give up one of his or her regular phone calls, forcing prisoners to choose between media and family contact.
Prisoners in disciplinary custody are effectively banned from any media contact. There are many prisoners who are, for all intents and purposes, on permanent disciplinary custody as they are in the SMU (Special Management Unit) or RHU (Restrictive Housing Unit) with absolutely no guidelines for what they have to do to get back in population. Some of these prisoners have been told, "you*ll never see population again."
Although according to the paperwork, the new ruling was issued October 11, prisoners did not receive it till late October. The policy goes into effect November 11, 1996.
The special clause about "compensation" should erase any doubts that this new policy is The Mumia Rule. The rule is similar to one enacted last year in California, where prison authorities were enraged about the publicity surrounding the case of Geronimo ji jaga (Pratt). It is part of a national trend to further strip prisoners of any constitutional rights, and give prison administrations license to do anything they want without public outcry.
The press needs to challenge this rule. Please contact your local media and foster connections with prisoners who would like to be interviewed. Also contact the ACLU in your area.

ペンシルヴァニア州矯正局は新しい規則を制定した。それによると、マスコミによる囚人へのインタビューに際して、カメラとテープレコーダーの使用が禁じられる。
また、あらかじめ取材者の名前を囚人の面会リストに登録しておく必要がある。（この手続きには、お役所仕事的なめんどうさと時間がかかる）
電話インタビューを受ける場合は、その分、家族との電話の回数が減らされる。
懲罰処遇を受けている囚人は、実際上あらゆるメディアとの接触を不可能にされる。こうした処遇を、永続的に受けている囚人もたくさんいる。
にもかかわらず、このルールは事務的に10月11日に公表され、囚人自身は10月末まで知らされなかったにもかかわらず、11月11日には施行される。
「報酬」に関する条項を見ると、これがムミア・ルール（ムミア・アブ・ジャマル氏への規制をとくに意識した条項）であることは疑いない。(*注)このルールは昨年カリフォルニアで施行されたものに類似している。これは、Geronimo ji jaga (Pratt)事件に怒った当局が制定したものである。（この事件について、詳細不明です）
全米的に、囚人から憲法の保証する人権を剥奪し、当局がやりたい放題やれるようになってきている。
報道関係者は、こうしたルールを認めるべきではない。メディアと連絡をとり、囚人がインタビューを受ける権利を確保しよう。

Compensation
It is a violation of Department policy (Inmate Handbook-2. General Information-Private Business) for any inmate to engage in a business or profession while under our supervision. Therefore, the inmate may not be compensated for participating in a visit or telephone call. Violation of this policy will result in disciplinary action being taken against the inmate, and the offending visitor's privileges will be subject to suspension.
当局の監督下にある収容者は、いかなるビジネスにも職業にもたずさわってはならない。したがって、訪問や電話インタビューによって、メディアから報酬を受け取ることは規則違反となる。これに違反した場合、収容者への懲罰、および違反マスコミの訪問の停止措置がとられることがある。
ジャーナリストであるムミア・アブ・ジャマル氏は、獄中からLIVE FROM DEATH ROWという本を出版している。この本の出版に関しては、彼に懲罰が加えられたり、出版社への圧力などがあった。また、最近もムミアはテレビのインタビューを受けており、（日本でも、NHK衛星第一放送で、「ジャマールは警官を殺したか？」というタイトルで最近放映された）こうした彼の活動に対する圧力であると考えられる。
