中国政府による日本人死刑執行通告に対する抗議声明

中国政府は、麻薬密輸罪で死刑が確定した4名の日本国籍者の死刑を執行する旨、日本政府に伝えた。赤野光信死刑囚(65)の処刑予定日は4月5日、武田輝夫死刑囚(67)、鵜飼博徳死刑囚(48)、森勝男死刑囚(67)ら3名の処刑予定日は4月8日とされている。

岡田克也外務大臣は、死刑執行が世論に与える影響について懸念を表明したが、日本政府として処刑を中止する具体的な要請は行っていない。

たとえ死刑存置国においてであっても、死刑は国際人権(自由権)規約第6条第2項にしたがい、最も重大な犯罪に限定されねばならない。そして、同規約委員会がスリランカ(1995年)、クウェート(2000年)、タイ(2005年)に対する総括所見において示しているとおり、薬物関連犯罪への死刑の適用は、同規約の求める最低基準を充足するものではない。

われわれは、中国政府による野蛮な殺害行為はもとより、みずからもまた死刑制度を存置し、これを必要とみなす日本政府が、内政干渉にあたるとの理由から、自国民を保護するための行動をとらないことをも非難するものである。監獄人権センターは、いかなる政府によるものであっても、またいかなる犯罪に対して科されるものであっても、死刑に強く反対する。そして死刑に反対する諸個人・諸団体と連帯し、全世界における死刑廃止のための取り組みを強めていくものである。

Statement on Imminent Execution of Japanese Citizens by China

China has informed Japan that it will execute four Japanese nationals for drug-smuggling.

The execution date of Mitsunobu Akano, 65, has been set for April 5th and that of the other three, Teruo Takeda, 67, Hironori Ukai, 48, and Katsuo Mori, 67, for April 8th.

Japanese Foreign Minister Katsuya Okada expressed concern over how the executions will impact public sentiment, but the government never expresses its demand specifically to stop the scheduled execution.

Even in the retentionist countries, the death penalty must be restricted to the most serious crimes within the meaning of article 6, paragraph 2 of ICCPR, and drug-related offences do not satisfy the threshold for capital punishment under the Covenant, as seen in UN Human Rights Committee’s Concluding Observations on Sri Lanka (1995), Kuwait (2000) and Thailand (2005).

We denounce not only China’s brutal act of killings but also Japanese government’s failure in taking an action to protect its own citizens on the grounds that Japan, which also retains the death penalty and deems the punishment as necessary, should not intervene in China’s domestic issue.

Center for Prisoners’ Rights Japan strongly opposes imposition of capital punishment to any crime by any government and strengthens its commitment to movement for universal abolition in solidarity with various individuals and organizations against the death penalty.
